1. Introductory Provisions

1.1. These General Terms and Conditions (hereinafter "GTC") govern the rights and obligations between the Seller and the Buyer when purchasing goods through the online store available at https://shop.jxmotion.sk.

1.3. The Buyer is any natural or legal person who submits an order through the online store.

1.4. By submitting an order, the Buyer confirms that they have read and agree to these GTC.

2. Subject of Sale

2.1. The Seller sells through the online store primarily:

go-karts
spare parts for go-karts
accessories and add-ons for go-karts

2.2. Go-karts are sports equipment intended for recreational or sporting use and are generally not intended for use on public roads.

Notice: 2.3. The Buyer acknowledges that the use of a go-kart involves an increased risk of equipment damage or injury.

3. Order and Contract Conclusion

3.1. An order is created by completing and submitting the order form in the online store.
3.2. After submitting the order, the Buyer will receive an order confirmation by email.
3.3. The purchase contract is concluded upon confirmation of the order by the Seller.
3.4. The Seller reserves the right to cancel an order in case of unavailability of goods or other serious reasons.

4. Price and Payment Terms

4.1. All product prices are listed in EUR and include VAT, if the Seller is a VAT payer.

4.2. The Buyer may pay for goods using the following methods:

bank transfer
online card payment
cash on delivery, if this option is available

4.3. The Seller reserves the right to require advance payment for certain products (especially go-karts).

5. Delivery Terms

5.1. Goods are delivered by courier service to the address specified by the Buyer.
5.2. The expected delivery time is usually 3 to 14 business days, unless otherwise stated for the product.
5.3. The Buyer is required to inspect the shipment upon receipt.

6. Withdrawal from Contract

6.1. The Buyer, who is a consumer, has the right to withdraw from the contract without giving a reason within 14 days of receipt of goods.

6.2. Withdrawal from the contract must be communicated to the Seller by email or in writing.
6.3. The Buyer must send the goods back no later than 14 days from the withdrawal from the contract.
6.4. The goods must be returned undamaged, unused, and complete.
6.5. The cost of returning the goods is borne by the Buyer.
6.6. If the goods have been used or damaged, the Seller has the right to reduce the refund amount by the value of the depreciation.

7. Specific Provisions for Sports Equipment

7.1. Go-karts are sports equipment intended for recreational or sporting use.

7.2. The Buyer is obliged to use the go-kart in accordance with the manufacturer's instructions and to follow safety measures.

7.3. The use of protective equipment is recommended, especially helmets, gloves, and other protective elements.

7.4. The Seller is not liable for damage caused by:

accident or collision
improper use
unprofessional assembly
unauthorized modifications
use contrary to manufacturer's instructions

Important: 7.5. Damage caused by driving or sporting use is not considered a manufacturing defect.

7.6. In the event of damage to the go-kart or its parts as a result of driving or an accident, it is not possible to return such goods under the right of withdrawal.

8. Liability for Defects

8.1. The Seller is responsible for defects that the goods have at the time of receipt and that occur during the warranty period.

8.2. The warranty period is 24 months, unless the law or manufacturer specifies otherwise.

8.3. The warranty does not cover:

normal wear and tear (e.g., tires, brakes, chains, bearings)
damage caused by accident
damage caused by improper use
unprofessional assembly or interference with the product

9. Personal Data Protection

9.1. The Seller processes personal data of Buyers in accordance with applicable laws of the Slovak Republic and the GDPR regulation.

10. Alternative Dispute Resolution

10.1. The Buyer has the right to contact an alternative dispute resolution entity.

11. Final Provisions

11.1. These General Terms and Conditions become effective on April 1, 2026.
11.2. The Seller reserves the right to change or amend these terms and conditions.
